Late Pay

I have been working as a consultant (W2) for an IT outsourcing company for 4 years.In the last year we have recieved only 1 pay check on-time. We are to be paid on the 1st and 15th of every month. One paycheck was delayed almost 6 weeks and the rest at least a week. They claim they are waiting for money to come in, so they may pay us, or bills had to be paid and they have no money. Now its been more than 30 days since we have been paid and they have told us they do not have a timeline for payment. I believe I can quit and collect unemployment, and I would like to go back to school. Will going to school have any effect on unemployment and is there any legal action I can take? I have been charged all kinds of money due to paying my bills late.

When Pay is Due

Under New York State law, an employer is suppose to pay employees within two weeks of the end of the pay period. You can file a complaint with the New York State Department of Labor.
