Is it legal for full-time off hours shifts to be excluded from a benefit (telecommuting) just because we don’t work the typical 9-5?

I work a full time weekend shift that has been fully remote for the last 15 months due to COVID-19. Recently, our office has begun the reopening process. Telecommuting has worked well and the day shift will be required to come in 20% of their working hours. For off hours with the same titles and tenure, evening and over nights are in person 50% and weekends (3 days weekly including Sat & Sun) 67%. This is clearly not “fair”, but is it discriminatory?
