If an employer chooses to include PTO or Paid Time Off towards

New attendance policy is being rolled out and our PTO time has always been included in OT calculation. PTO is still being under the new policy will still be included in our overtime calculation EXCEPT when PTO time is used to cover a tardy. In that instance the PTO will only be paid out as "regular" pay and the PTO used to cover the tardy doesn't count towards OT. If PTO is used for a full absence or an early departure or for a scheduled period of absence it will count towards the OT calculation. I know there is no FLSA standard to have pay PTO towards hours worked, but I'm curious if there is any rules that if the employer chooses to pay PTO as counting towards overtime or "hours worked" can the employer specify what instances the PTO counts towards hours worked? It would seem that all PTO hours should be treated the same as either counting towards the OT calculation or not.
