If an HR policy exists stating "ineligible for rehire" will not given out but they are..

I recently discovered my previous employer with whom I did not leave on good terms with is providing the information that I am "ineligible for rehire" which is keeping me from finding work. I also recently found out that their HR department has a policy stating that this information would not be provided to prospective employers. Can I sue?
