I was verbally offered a position as an analyst two Thursdays ago from the VP of HR of that company.

My guestion is, do I have a case here? They offered me a job and even though I did not turn them down, without even telling me that they had offered this position to another individual they give it to another.
I was verbally offered a position as an analyst two Thursdays ago from the VP of HR of that company. I told her specificly that I would like to speak to my husband over the weekend regarding the offer and that I would call her on Monday. I then called her on Monday with my answer and she did not answer her phone so I left a message stating that I would call her the next day since I would be in and out running erands. She left a message on my voice mail thanking me that I had kept my word and called her. I then called her on Tuesday and asked her to be a little more specific regarding stock options that they had offered. She then replied that the jobe had been offered to another candidate and that she would get back to me. Hours later that day she calls and states that they are going to go with the second candidate.

What One Hand Giveth...

Unless the employer had a contract with you to employ you for a certain length of time, the answer is going to be "no." Texas is an employment "at will" state, which means that -- even though you accepted the offer -- the employer could have fired you the nanosecond after you showed up to work, for no reason at all. So, you may (technically speaking) have a breach of contract claim (offer + acceptance = a contract), there are no damages.

If you had an agreement with the employer as to a promised length of the employment, however, please see a lawyer.
