I am a school employee. I have had fmla for 5 years for my 2 boys with Duchenne Muscular Dystrophy. This year I have fmla for them, my daughter that has asthma and my self for anxiety. Hr told me that my job is in jeopardy because of excessive absences. All my absences are covered by fmla. She is telling me that when much contract is up for this school year they will not renew my contract for next year because of excessive absences. She is saying once my contract is up and my fmla is up they can do that because Virginia is an at will state and they can fire with out reason. Can they? What good is fmla to a school employee. Let me add that I have only taken less than 3 weeks of intermittent leave with out pay.
