how can my job (chapel hill transit tell us that we have to give 24 hour notice if we need use FMLA

i have FMLA for myself, yesterday we were called in the office (everyone with FMLA) AND THEY ASKED US TO SIGN A PAPER TELL THEM THAT WE WOULD GIVE A NOTICE IF WE HAVE TO USE FMLA, WE THATS NOT ALWAYS POSSIBLE, LIKE WITH MY BREATHING CONDITION, (ACUTE ASTHMA).I UNDERSTAND THAT SOME PEOPLE ABUSE IT BUT IM NOT ONE OF THOSE PEOPLE, SO WHAT ARE MY RIGHTS?

I don't know whether the law or its regulations continue to read in this way, but at least in an earlier form the law spoke of giving notice to the employer "as soon as practicable" when it isn't foreseeable. You obviously have a particular medical reason. I would advise you to ask for a private meeting to explain why your need is unpredictable. If you could offer--or bring with you to the meeting--a statement from your doctor that explains that your need can be completely unpredictable, I would like to think they will be flexible with you. They won't want you telling coworkers that you get to take leave without notice because any of those coworkers may use your example when they don't deserve the same treatment you get. So, I recommend that you speak with them and provide medical backup if they want it and then make discrete arrangements that your employer can accept.

If the employer does not work with you, then you should hire counsel to intervene for you.
