Ex-Employer owes me $10,000+ in payroll & expenses

I was laid off in February 2003. As of today, 1/6/04, my ex-employer still owes me approximately $10,000+ - payroll & expenses. My question is should I file a claim at Department of Labor or sue him in court. I have been sending him emails & his response is that he does not have money now. (He has been living in Thailand for the last 2 years & lives at a hotel) I have not received a penny from him since I left. Please respond asap. Thank you.

You can file with the Department of Labor. You can also file in Federal Court. In addition to what you are owed, the Court can also order the Defendants to pay liquidated damages in the same amount and your attorney's fees. But as always, an attorney needs to review the specifics of your case to be able to give you sound legal advice.
