Employer deducts perdiem from wages, reimburses it (tax free) & claims he paid my per diem

My husband and I are over-the-road truck drivers. Our employer deducts standard meals per diem ($63/day) from both of ours gross pay. He reimburses the $63/day during the same pay period. They say it's done so we don't have to pay taxes on it. Now they're telling us they're claiming they paid our standard per diem on their taxes and we can't claim it on our taxes. They paid us nothing towards per diem. The W-2's show have no reference to this with the gross income and taxable income being the same. I don't see how this works and feel like it may be fraud.
