Do I have recourse if laid off upon returning from WC claim?

Our Company filed for bankruptcy in Feb 09 and I went out on a WC claim in Mar 09, currently still on leave.

During hard financial times company has not laid anyone off even when it made financial sense and they are non productive employees as well.

My doctor said I could return to work with modified duties and the company said they had no modified duties and wanted me to return when I am fully released without restrictions.

I have sense learned that the owner intends to terminate me upon my return since business is slow.

Do I have a case sense they have not laid anyone off due to slow economy and there are employees who have been there less time than me and I do a far better job than they do. Some of the ones still there should have been let go for incompetence in the first place and they have not been let go even when business is slow.
