Conflict of interest (working for 2 employers of same industry)

Emp(a) at co(a) accepted a position at co(b). Co(b) needed an admin & asked an ex co-worker to take the job. That person has not received an offer letter nor have they signed any documents stating they have accepted the job. However, prior to co(a) opening they helped them write up a document & sent it to the contact person of co(b) from their work email. They pulled up co(a)'s document, paraphrased it & submitted it to co(b). They have also helped show them how to do a particular job. They haven't gotten paid for anything, they have only offered advice, but co(b) has him/her down as the admin. although they have not accepted the job. They have not comm. since co(b) opened. They are investigating a confidentiality breach. Can they go to jail, have their licensure revoked, black balled. What are they facing?
