Comissions earned can not be considered theft, can they?

Working as a recruiter, I got quarterly commissions, which were paid at the end of each quarter(this quarter Number 1). I got terminated the end of the 1st month of the (guarter number 2); having 2 more months to meet my quota. My ex employer states if you do not meet (quarter number 2) quota you are responsible for with held commissions in quarter number 3 to compensate. However since I did not meet my quota and was paid the previous quarters commissions, not meeting (quarter number 2) quota I have been accused of theft. Is that legal? Those were earned commissions.
