Can my company withhold my last check as reimbursement for moving expenses

I had a 5 year deal for $5k of moving expenses and resigned. They have witheld my last check as reimbursement. Is this legal?

Technically not, but if you entered into an agreement which gives them the ability to recover those monies you are indebted to them in the amount of $5K so it will matter little when and in what form those monies are tendered. I recommend that you have someone look at your moving/relocation agreement.
