Can my FMLA be disclosed on my performance review?
I have worked for a company for the last 5 years with excellent reviews. I have always had very good performance reviews. This past year, my performance review was good also. THe only thing that bothered me is that my manager mentioned that I have intermittent FMLA. She worte that "JOHN DOE has managed his attendace with intermittent FMLA and have been asked to manage it accordingly". I dont feel that my FMLA has anything to do with my job performance or she has the right to disclose that in a document like that.
Just recently I applied for another job within the company. The hiring manager called and got a release date on me and requested my performance evaluations. After they got the evaluations, they went cold. I never heard from them again. My immediate manager talked around the situation and said that they were having budget cuts. I have heard that this is not the case. I want to know if she can publicly disclose my FMLA in a performance evaluation document. When I spoke with my FMLA representative, He said that he would ask her to not mention it in any future evaluations. Were my rights violated? I really feel that because the mention of FMLA was on my review; that is the reason they didnt go foward on hiring me.
