Can an employer withold a final paycheck if I refuse to sign a non-compete?

My husband did not sign a non-compete clause when he began working for an employer 5 years ago. He put his 2 weeks notice in with the company owner in writing 13 days ago. The employer is now telling him if he doesn't sign a non-compete, they will withold his final paycheck. Can they do this?
