Bonus withheld

I recently received an "unacceptable" performance evaluation from my manager. The evaluation is inconsistent with feedback provided throughout the year and contains factual inaccuracies. As a result of this evaluation, I will not receive a bonus for 2004, no stock options and likely will not remain with this employer to see last year's options mature. My manager is something of a "golden boy" and was recently named to serve in his superior's position on an interim basis to fill a vacancy. I now have to record my comments on the evaluation and am unsure how much informaion to include. In addition, the bonus and options total to +/- $100K. What remedies do I have going forward?

I recommend that you visit with a local employment lawyer to get help writing the document. You have to be politic and polite. You don't want anything in that letter to come back and haunt you later. I'm not sure you "have" to record your comments on the form. Couldn't you write a letter?

Make an appointment and get some sage advice. That's a lot of money at stake and perhaps a small investment of money and time will get good results. If it doesn't help in the short run, you might have to later think about a breach of contract action -- and you do not want anyone on a prospective jury to secretly dislike you because they perceive you as rude, grasping, whiney, or [fill in the blank with any other negative term]. A respectful tone and a well-written letter is imperative.
