Am I required to use Family Medical Leave?
I have 8 months of accumulated sick leave. I have minor surgery scheduled and will only be out of work 1-2 weeks. Am I required to use Family Medical Leave?

If you do not ask for FMLA leave and the employer does not designate your leave as FMLA leave within two days of your return, then you may be able to avoid the use of FMLA leave. I have not had to research this question recently, so please understand that this advice might not be accurate any longer. I don't know why you are not asking the employer. I wonder why. One other qualification to this answer is that I am assuming that you meet all the criteria to claim FMLA leave....
