when is severance pay due in california? i'm growing impatient....

i was promised a month's severance. it's been over a month since i left. when is severance pay due to an ex-employee? i signed a release but i think i'm being led around by my nose....

when the agreement says so

severance pay, as opposed to wages, is due when the agreement providing for the severance pay, says it's due. you say you signed a "release"? is this a written agreement giving you severance pay in exchange for a release? if so, the agreement is not enforceable if they have not paid you the consideration (money) they promised for your release. if not, then you have nothing but an oral agreement.

in either case, your remedies are those for contracts. that is, you have to sue for their breach of the promise to pay severance. if they have gone bankrupt, or out of business, you'll have a heckuva time collecting.
