What rights does an employee have when an employer replaces them before they have given notice? An employee talked about going into the daycare business b/c she was having problems with babysitters. Our boss found out and hired a new MA. The employee will work 2 more weeks fulltime and they are then cutting her to part time. She now is scrambling for kids to babysit b/c she never gave a 2wk notice. Can they do this?

Under Florida law there is no requirement that an employer give an employee any notice before cutting their hours or terminating them. Florida is an "at will" state, meaning an employer can terminate you at any time for any reason as long as it is not based upon illegal discrimination or illegal retaliation. Likewise, an employee does not have any legal obligation to give any notice before quitting their job.
