paid for my accrued unused PTO (NYS)

I resigned and believed under NYS law I was entitled to be paid for any accrued unused PTO which was over 120 hours. Company response was that the employee handbook said "that there is not a requirement under New York law to pay out accrued unused PTO upon termination when the employee’s agreement and company policy expressly state that such payments need not be made, as noted in our Employee Handbook."

Just wondered if I had a right to pursue my unused PTO regardless of a employee handbook. I know they paid it out for an employee who was fired working out of MA.
