There are several issues related to electronic communications which are not easily anwered in this type of format. Initially merely having a policy that company computers are to be used for work purposes only doesn't determine whether the employer has given sufficient notice that an employee has no privacy rights to the communications. Also, the question of interception and use will arise. All of this implicates the ECPA or federal wiretapping statute. In essence, see an employment attorney near you and ask in advance if they have any experience with ECPA or wiretapping issues.
