ee took time off to care for father - was not told it was classified as FMLA - father passed away -

Father just passed away over the weekend - employer was not counting previous time off as FMLA - what is the employer required to do NOW since the father passed away or should do when she says she needs more time off in addition to what she has already been given? Can she have any FMLA time since he has now passed away or would it be up to the employer to grant her a LOA to take care of what she needs to do. Can we require her to take any vacation time that is available? Today is 1st day at this company and this is my 1st task to "handle" - Thanks!!!
