dont understand my rights

I got a call from HR today and he stated that I no longer have a position. That I am not terminated but when I come back to work they will try to find me something to do. While I still out do my benefits stay the same or they cut. will I have to take a cut in pay and benefits.

If you are out because of a workers compensation injury, then that is a special situation and I would suggest that you obtain a workers compensation lawyer.

If you are out on FMLA, and your 12 weeks has not expired, then you should obtain counsel right away. If your 12 weeks has expired, your rights may be much more limited; however, I would recommend obtaining counsel to see whether you have a possible disability claim.

FWIIW, the company HR person sounds open to talking. I would suggest that if you have a reasonable level of trust in the HR person, I would ask him/her your questions. Whatever responses you receive, I would put in an email back to the person to confirm what you understand. Ask them to write back and confirm or clarify what you have said.
