can an employer have an extended holiday (labor day) and require hourly employees to use a vacation day or accept a non paid day and can they require a salary person to use a vacation day

business is slow therefore the company decided to extend labor day to include Tuesday as day off and have hourly employees use a vacation day or take a non paid day off and have salary people use a vacation day, is this legal?
