am i entitled to overtime as a subcontractor

I was hired last year by this company and listed as a subcontractor in carpentry. I am a general laborer. I don't know anything hardly about carpentry. I get paid by the hour and straight time no overtime over 40 hrs. I am told what time to start when to take lunch and when to end the day. I also have a foreman on the job that bosses everyone around being told what to do every minute. Am I a subcontractor or an employee and am I entitled to overtime? My understanding of a subcontractor is you are your own boss and set your own hrs. I feel this company's practices are illegal. I may be wrong but something is just doesn't feel right.
