Texas employee handbook states 1 to 5 years 2 weeks vacation and after 5 years 3 weeks vacation. My 5 years is May 1, however, employer states that my increased accrual from 2 weeks to 3 weeks paid vacation won't start until the following year in January.

May 1, 2017, will be my 5 years at texas place of employment. Employee handbook states 1 year up to 5 years is 2 weeks vacation and after 5 years 3 weeks vacation. I am expecting my increased vacation accrual to start on May 1, however, employer is stating it won't start accruing until the following year on January 1, 2018, which I will be there 5 years and 7 months. Is that legal
