Severance that is not continuation of salary

I was laid off in July 2002 and was offered a severance package that includes an agreement by me to travel to any location specified by my former employer to testify in behalf of them in any action against them without compensation other than travel expenses. Does this change the nature of the payment from continuation of salary that reduces my unemployment to a payment for testimony that would not be held 'against' my unemployment?
