One employee is excused & the other employee is not excused

Lets say that employee #1 is excussed from being on the "on call duty list at night" because of taking a medication. Employee #2 (on FML) is taking the exact medication but yet employee #2 is required to go to company doctor & is declared unfit for duty. Company doctor is paid by company - not by employee. Company doctor tells employee to get off medication before he can go back to work. Company told employee #2 to go to company doctor on employee own time.

Sounds like cohersion & Workplace discrimination also to mention that FML laws are being bent?

Employee #2 has been taking "said medicine" since 04/2010 and company is just now on the bandwagon.

Any ideas - thoughts? ... many thanks
