Is this legal ?

The company I work for penalizes us with POINTS for taking our earned PTO unscheduled (say for an emergency,unexpected illness). When we reach a certain amount of points we are given a warning with repercussions. If this is PTO we EARNED, why do we get penalized. We rarely ever get approved for SCHEDULED time off because they will only let 0 or 1 person our per day so basically they are forcing you to call in unscheduled time and get the points. I find this to not be legal. It's OUR time, we worked extremely hard to obtain it.
