Is my non solicitation valid

I have a non solicitation agreement with my employer's employer. My employeer is an insurance agent(independent contractor of the insurance company he sells for). I don't have any written agreement with him at all but I have one with the company I was appointed to sell with due to me working for him (my empoyer). It states in the contract that I was not an empoyee or independent contractor of the company and that agent is responsible for my employment, pay, ect. Isn't the non solicitation between my employeer and me, not the company he sells for? Thanks
