Is my non-compete enforcable if I was only employed for a short period of time?

I started a home care business in 10/2014. At the time, I had one business partner. We purchased everything we needed including how-to books, templates and so on from the internet. My business partner and I later decided to bring in my sister and wife because they are both nurses. My wife, however, spent some time working for an aunt that also owns a home care business in the middle of the ownership transtion. My aunt was fully aware of the business because we even discussed merging at one point. At any rate, my wife did sign a non-compete, but it did not apply initially because my wife was working as a sub-contractor. One day my aunt randomly started taking out taxes and said she put my wife on the payroll. Come to find out, this was her way of getting the non-compete to be invalid. My wife terminated her employment and a few months later she took over part ownership in my company. My wife spent MAYBE 2-1/2 months emplyed for my aunt and worked very limited hours during that time. She has years of experience in nursing at various levels, including home care nursing. We did not contact any of my aunts employees, clients or use any of her document/
