Is it legal for an employee to handle his own SH case?

An employee has been brought up on charges of sexual harassment and instead of the investigation remaining confidential the Owners of the company tipped off the employee. Now the employee has been heard giving advise to the owners on how to handle his own claim. Not giving HR the opportunity to sit down and speak with the employee regarding the charges. What can done now that the investigation has been compromised?
