Is it illegal for a potential employer to run a background check without permission?

I applied for a position by submitting my resume (basic info: work and school history). I had two interviews, neither of which I signed or filled out any paperwork giving them permission to run a background check, nor was it even verbally discussed. However, on the first interview they did take a copy of my SS card and driver's license, which I assumed would be used later down the road (with my consent). I was about to be offered the position, when the company called me back and said they couldn't hire me because I didn't pass the background check. If this illegal, what sort of legal action can be taken?
