Is employer required to follow FMLA policy, require use of paid leave

My employer FMLA policy "requires employees to substitute any available accrued sick leave, accrued vacation or compensatory time (comp time) in this stated order of priority as applicable, for any unpaid FMLA leave." HR states that I can not use accrued sick time with FMLA for a new baby though since I will be bonding with my child, which is not a "serious medical condition"
I would prefer to use accrued sick time rather than take unpaid FMLA.
