In order to get employees back in the office, the company has instituted a mandatory must be in the office 4 days a week and can work from home the 5th. Now they are saying that if you are not complying it will affect your evaluation, even if working from home has not affected your work. Also, different departments have been enforcing this differently for their team members. They also have employees who do not live near a facility so they are allowed to work from home full time. Is it legal to use this policy to decide whether an employee meets work expectations and possibly withhold any raise?
