I'm past my two year non compete?

Can a past employer come after you if you are now working with a competitor after my non compete has expired? I am well passed the two year term of not allowed to compete. I have allowed their competitor to manufacture/sell a patented idea of mine that I created/designed that would directly compete against my past employers similar product. With regard to "created/designed" I was doing this during my two year non compete with an engineering firm and not technically competing as it was only in the design phase.
