If an employer payed the employee equal to or more than the amount of overtime...

If an employer payed the employee equal to or more than the amount of overtime but did not title it "overtime pay," there is no problem right?
Also, is there a rule prohibiting the act of countersuing to cover the criminal actions already done by the plaintiff? (In another words, plaintiff takes action to deviate the case from his criminal act)
