I received a severance payout in 2016. My ex employer did not file the 1099 until 2017? is that legal???

I was let go from my job of 25 years as I am over 55 in November 2016, and as they stated I no longer fit the new company profile and image. With that I accepted and received a severance payout in December of 2016. And i specifically stated to keep this the 2016 tax year. My ex employer waited until this year 2017 to file the 1099 form. Now I have an additional income that I need to account for. Is that legal for then to hold off on year before filling the 1099?? Thank you.
