I read that it is KY state law for an employer to pay an employee for their unused vacation time (with pto being considered vacation time) when that employee is terminated. But when I speak to HR about it they say that they do not give pto payouts to terminated employees. So which is correct? Does their being considered a non-profit organization make them exempt from that law? I am lost on what to do. And since my termination the new year has begun so all of my pto was reset. Does this mean that I lose any pto payout that I may have been entitled to before the reset that occurred after my termination?
This is in the state of kentucky.
The termination was because I did not have reliable transportation to work and would also sometimes have difficultis getting there due to my disorder which led to me being tardy to work too many times.
I worked there for 3 years before being terminated.
One HR representative that I spoke to told me that I did get a pto payout in the case of an involuntary termination, but then the one that recommended my termination called me back to inform me that I do not and that the other representative was mistaken.
