I haven't received my severance pay in the time frame provided.

Hi, my employment was eliminated effective august 17th. I received a severance agreement and signed it effective august 25th. In the agreement in paragraph 2, section a, it says my lump sum will be released on the next standard payroll date. That date was august 28th. I got an email confirmation from Human Resources that I will receive my payment on September 11th, which is the next payroll date. Today is September 11th and I still haven’t received my payment. I called and they said I had to wait till next payroll date. My question is, do I have a legal case for breach of contract according to my agreement? Thanks, Nishan

An available and stronger claim is unpaid wages in violation of the California Labor Code. If successful this will allow you to collect penalties, interest and attorneys fees. You can pursue this claim with the California Labor Commissioner. Look them up on line. If the amounts are high enough hiring an attorney is also possible.

It is a breach of contract, as well.
