Exempt or Non-Exempt Employee?
In California, I know that I would not be considered an "exempt" salaried employee if I am not performing executive, administrative, OR professional duties more than 51% of the time. However, if the executive, administrative, AND professional duties performed within the same position totaled more than 51%, would I then be considered exempt? So basically, is the 51% Rule conditional upon each exemptible category or can they be combined to meet the requirement?
