Does age discrimination apply in this case?

We are three per-diem seasoned employees, ages 56-61 and are being told that we are not being called in to work (given a large amount of lack of work over the last six months)because our new manager is using the prns that the the "most productive." Up until this new manager was hired, we were all working 2-4 days per week. We all have evaluations from Dec 2013 that are good, with no deficits noted, especially concerning productivity; in fact, quite the opposite is noted. This manager is using only young prns and recently hired a new prn, young as well. Do we have an age discrimination case? Thank you so much!

The facts as recited will support a claim of age discrimination. You really need to discuss this situation with an employment lawyer. In order to prove a claim of age discrimination you will need to show that age was a determining or but for reason for the employer's actions.
