Docking Pay for Not Providing Doctor's Note

Is it legal to dock an exempt employee's pay for a day that they missed for being "sick"? This employee refuses to provide a doctor's note. Usually we require a doctor's note after 3 days, but he has a file full of warnings and write-ups from the company, so the boss is requesting he provide a note for this one day he missed. It is assumed he was out partying late and so he couldn't make it to work. This is what the previous write-ups and warnings were regarding. Can the company deduct pay for that day missed if he fails to procure a note?
