Can non-compete agreement prevent you from earning money?

My husband was fired for poor performance. No severance package, nothing. Now he found a new job. But his former employer sent him a reminder about a non-compete agreement for one year. And it basically says you can't do your job for one year. How does he suppose to earn money for his family? Definitely, going to macdonalds will not cover our expenses. By the way the employer haven't even signed this non-compete, but my husband did.
