Can my Boss keep me from participating in the Company 401K program?

I have been with the Company over one year (the required time); I received the paperwork to join; I inquired about the plan and today my Boss said, "I'm not giving you any more money until you "fix things" around here"; I'm a Manager and he's not happy with the way the business is going.

I have no wrie-ups or disciplinary actions in my file.

Your employer must comply with the provisions of the plan. The Internal Revenue Code and the Employee Retirement Income Security Act (ERISA) prohibit plans from requiring more than 1 year of service as a condition of participation, unless the employee is under 21 years of age.

For a detailed analysis of the facts and an explanation of remedies you should consult an attorney privately.
