Can i filelawsuit if manager is unfair & starts treating differently

My manager started disliking me after I talked back to him since he had different treatment to other team members vs me. t got worse & then he stopped helping giving directions to me in the project. I complained to HR. They heard my story & told me there were lot of employees before who had complained against him before. But everything changed when they spoke to my managers boss & they turned the tables against me & started pinpointing weakness in my work. My manager nitpicked & wrote small things such as discussions, clarifications , normal business flow which I had asked throughout the year as my weakness & stated that I should have known but I need lot of help in my review. I told HR that he is now retaliating & there was no notification throughout the year that my performance is not meeting expectations. But HR is just supporting him & now they are doing my performance evaluation in which he is still bringing up small issues , clarifications as my weakness & projecting as concerns to HR. I don't think I stand a chance of winning over this. Can I file retaliation lawsuit or any other lawsuit against them.

To bring a lawsuit, you must prove that conduct is illegal; all that is unfair is not necessarily illegal. Laws that prohibit retaliation for protected activity include the N.J. Conscientious Employee Protection Act, the Law against Discrimination, the National Labor Relations Act, and federal laws prohibiting discrimination. To determine whether your employer has violated any law, you should consult a lawyer to review the nature of the issues you raised and other factual details.
