Can an employer take your PTO or UPTO as punishment if you come back early from you break and or lunch?

To ensure adherence to the break and lunch policy my employer has just announced that they will be taking 30 min of our PTO or UPTO if our breaks are less then 10min or our lunch is less then 25min. Is that legal for them to take our UPTO and PTO as punishment for taking a 9min break instead of 10 or 15min or taking a 24min lunch instead of a 30min lunch.
