Can a nonunion nonbenefitted employee be denied participation in a severance program?

A union employee at one campus of a hospital chain is given a severance package. Can a nonunion nonbenefitted employee at a different campus be denied a severance package given that the hospital always assured the nonunion employees that they would be treated the same as the union employees?
