Can a company have a non-compete with only SOME of employees in the same postions/levels ?

I have an employment agreement that seems to be very restrictive. It lists over 100 companies i can not work for.

While researching this, I found 3 other people in my company, were not required to sign one. They are my equals, the only reason they may not have one is an oversight, or the state they work in does not permit them (CA, MO, CO).

Is it possible to formulate an argument that due to the inequity of the application, that they could be nullified?
