Can HR create a new case in the middle of 1 case if the original allegation was found to be u sabsta

I was originally accused of physical and verbal abuse. But as our department finished their investigation, the physical abuse was unsubstantiated as there were no evidence found that I have done so. But my department found to have the verbal abuse allegation “substantiated”. Then they forward this investigation to HR, so it can makes it’s own investigation and determine what to do with me. Upon HR’s further investigation, HR found that a verbal abuse can not be substantiated too. Supposedly no more case right? But HR created a new allegation to attach to this. HR created “in attention to duty” and this is substantiated and therefore recommended me to a 5 day suspension. Can HR do that?
